By downloading, accessing, or using NeoGen ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

NeoGen is an AI-powered creative studio that allows users to generate images, videos, and other visual content using artificial intelligence. The service includes tools for prompt building, style fusion, character creation, and more.

3. User Accounts

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to use NeoGen to:

• Generate content that is illegal, harmful, threatening, abusive, or defamatory.
• Create content that infringes the intellectual property rights of others.
• Generate content depicting minors in a sexual or exploitative manner.
• Attempt to reverse-engineer, hack, or disrupt the App or its underlying systems.
• Use automated tools to scrape or bulk-generate content beyond normal personal use.
• Impersonate any person or entity.

5. AI-Generated Content & Ownership

Content you generate using NeoGen is intended for your personal or commercial use, subject to the following:

• You retain ownership of content you create using your own original prompts.
• You grant NeoGen a limited, non-exclusive license to store and display your content within the platform.
• NeoGen does not claim ownership over your generated content.
• You are solely responsible for ensuring your use of generated content complies with applicable laws.

6. Subscriptions & Payments

• Some features of NeoGen require a paid subscription (NeoGen Pro).
• Payments are processed securely via Paystack, which supports card payments, mobile money, and local bank transfers across African countries.
• Subscriptions are billed per billing cycle and remain active until the end of the current paid period.
• Refunds are issued at our discretion; contact support within 7 days of a charge if you believe an error occurred.
• Prices may change with 30 days' notice to subscribers.

7. Termination

We reserve the right to suspend or terminate your account at any time for violations of these Terms, without prior notice. You may also delete your account at any time from within the app settings.

8. Disclaimer of Warranties

NeoGen is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the App will be uninterrupted, error-free, or that AI-generated results will meet your expectations.

9. Limitation of Liability

To the maximum extent permitted by law, NeoGen shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, revenue, or profits.

10. Governing Law

These Terms shall be governed by and construed in accordance with applicable international law. Any disputes shall be resolved through good-faith negotiation, and if unresolved, through binding arbitration.

11. Changes to Terms

We may update these Terms from time to time. Continued use of NeoGen after changes are posted constitutes your acceptance of the updated Terms. We will notify users of material changes via the App or email.
